THE CONSTITUTION OF THE SERVICE DELIVERY PARTY (SDP)

1. PREAMBLE
Whereas the Service Delivery Party (SDP) was founded in 2024 in Mpumalanga to protect and promote the rights and privileges of disadvantaged communities suffering from inadequate service delivery by government institutions; And whereas, quite independently and without prior interaction, a similar formation arose in the Western Cape in 2025, motivated to sharpen the focus on techno-democracy in order to enhance service delivery through expertise on the one hand and on the other ensure that the people have a greater voice in governance, in honour of the iconic phrase: "The people shall govern"; And whereas the congruence of vision and purpose between these two formations was so profound that it was agreed they should merge, thereby becoming united champions of democratic rights and ardent promoters of effective service delivery; Therefore, the SDP undertakes to advocate for and empower the people throughout the Republic of South Africa, with particular commitment to the forgotten and underprivileged communities, so that service delivery, guided by the National Development Plan (NDP) and the respective Integrated Development Plans (IDPs), may be realized in practice and brought to full fruition.

2. NAME, NATURE, AND SYMBOLS
2.1 The name of the organization shall be the Service Delivery Party (SDP), pronounced SeDePa with an elongated "e" to constitute the acronym.
2.2 The SDP is a national political party registered in terms of Section 15 of the Electoral Commission Act, 1996 (Act No. 51 of 1996), and the Regulations for the Registration of Political Parties, 1998.
2.3 The party's emblem shall be a stylized gear icon, symbolizing efficiency and delivery. The emblem shall incorporate the colours green, yellow, black, blue, and red, representing national unity, trust, openness, and growth.
2.4 The official party colours shall be brown, green, yellow, blue, and red, representing diversity, resilience, renewal, trust, and sacrifice.

3. AIMS AND OBJECTIVES
3.1 The primary aim of the SDP is to promote visible, effective, efficient, proactive, and equitable service delivery across all spheres of government, as envisaged in section 41(1)(c) and section 195(1) of the Constitution of the Republic of South Africa, 1996.
3.2 Consistent with its founding values and the constitutional principles of human dignity, equality, and non-discrimination as set out in sections 1(a), 7(1), and 9 of the Constitution, the party commits to respecting, protecting, promoting, and fulfilling the inherent rights and legitimate interests of all persons.
3.3 In pursuit of its primary aim, the SDP shall pursue the following objectives: (a) Autonomy and implementation capacity; (b) Participatory governance and community engagement; (c) Electoral and governance reform; (d) Merit-based public administration; (e) Civic and constitutional education.

4. MEMBERSHIP
4.1 Membership of the SDP is open to all South African citizens and permanent residents aged sixteen years and older, irrespective of gender, colour, race, or religious affiliation.
4.2 Categories of membership: Supporters; Volunteers; Organisers; SDP Champions (honorary).
4.4 Termination of membership may occur by resignation, expulsion for cause, or non-payment of dues. Expulsion requires a fair hearing before the Advisory Council of Retired Representatives (ACRR).

6. ORGANIZATIONAL STRUCTURES
6.1 The Federal Executive will include all key office bearers and will be the highest authority.
6.3 Only those who were former members of a national, provincial or local government legislature may hold permanent positions in the Executive Structures.
6.4 Key office bearers: Federal Leader (annually elected, rotational); Federal Chairperson (annually elected, rotational); Federal General Secretary; Federal Chairperson of Finance; Deputy Federal Chairperson per province.

7. NATIONAL COORDINATING COMMITTEE (NCC)
7.1 The NCC shall serve as the principal coordinating and strategic body of the Party between National Conferences.
7.3 The NCC shall consist of between 30 and 50 members, drawn from public representatives, recognized experts, and community-nominated delegates.
7.4 No single president or chairperson for life. Rotational leadership with fixed 12-month terms.

12. PUBLIC REPRESENTATIVES AND ACCOUNTABILITY
12.1 Councillors, MPLs, and MPs shall have substantial autonomy to deliver services in their mandates, free from party whips on operational matters.
12.2 Mandatory public reporting via quarterly dashboards; voter feedback loops and recall petitions; performance reviews tied to re-selection.

16. REVOLVING LEADERSHIP
16.1 Each key position shall rotate every 12 months. Incumbents may not serve consecutive terms or more than two times in a five-year cycle.
16.3 Candidates must demonstrate at least 5 years' managerial experience and pass a merit assessment.

17. AUTONOMY OF ELECTED REPRESENTATIVES
17.1 Elected SDP representatives shall enjoy substantial autonomy to propose and execute service delivery projects; make inputs on legislation/budgets/motions without prior party approval; form ad-hoc alliances for delivery-focused initiatives.

24. DISCIPLINARY PROCEDURES
24.1 All disciplinary decisions shall be lawful, reasonable, and procedurally fair, in accordance with section 33 of the Constitution and PAJA principles.
24.2 A member subject to disciplinary action shall receive written notice of allegations, be informed of provisions allegedly contravened, and be afforded a reasonable period to prepare a response.

28. GENERAL
The party shall have a perpetual life span, unless the National General Conference passes a resolution to dissolve with 65% vote by the voting delegates.

29. AMENDMENT OF THE CONSTITUTION
The constitution may only be amended by the National General Conference on the vote of 50% PLUS 1 of voting delegates attending the conference.
